Opinion | The Trump Warrant Had No Authorized Foundation

By David B. Rivkin Jr. and Lee A. Casey

Was the Federal Bureau of Investigation justified in looking out Donald Trump’s residence at Mar-a-Lago? The choose who issued the warrant for Mar-a-Lago has signaled that he’s prone to launch a redacted model of the affidavit supporting it. However the warrant itself suggests the reply is probably going no—the FBI had no legally legitimate trigger for the raid.

The warrant licensed the FBI to grab “all bodily paperwork and data constituting proof, contraband, fruits of crime, or different objects illegally possessed in violation of 18 U.S.C. §§793, 2071, or 1519” (emphasis added). These three felony statutes all handle the possession and dealing with of supplies that comprise national-security data, public data or materials related to an investigation or different issues correctly earlier than a federal company or the courts.
